Previously, disputes regarding sectional title schemes were addressed through expensive and lengthy litigation or arbitration proceedings. The practical outcome hereof was that many aggrieved owners simply did not have access to recourse.
This changed when the Community Scheme Ombud Service Act 9 of 2011(the “Act”) was enacted. As a result, disputes can now be lodged with the Community Schemes Ombud Service (“CSOS”).
As with many other industry ombud structures, approaching the ombud is free of charge and should be speedier than the traditional litigious route.
